# Terms of Service Effective Date: 2024-12-11 Welcome to Dinefy ("Service", "we", "our", "us"). By accessing or using our service, you ("user", "you") agree to these Terms of Service. If you do not agree, please do not use the service. ## 1. Overview of the Service Dinefy allows users to automate restaurant reservations on their behalf by: - Logging into their Resy account using their email and password. - Creating "Playlists" by selecting Resy Lists and scheduling reservations. - Automating recurring reservations based on the user's defined schedule, and using Resy's public API endpoints. ## 2. User Account and Responsibilities ### Account Access and Consent - We only store your Resy password after obtaining your explicit consent through a checkbox during the sign-in process. - You agree to provide accurate credentials for your Resy account. By doing so, you authorize us to use this information to access your Resy account solely to perform the services described. ### Account Security - Your credentials are encrypted and stored securely in Supabase. We do not share your data with any third party except as necessary to provide the service. - Compliance with Resy's Terms: You are responsible for ensuring your use of Dinefy complies with Resy's Terms of Service. ### Reservation Responsibility - Reservations no-show fees: Some restaurants charge no-show fees. You are responsible for cancelling the reservations created by Dinefy in your Resy account in case you decide not to use it. ## 3. Use of Data - **Storage**: We store data on Supabase (https://supabase.com/). - **Encryption**: Your Resy password is encrypted before storage. We use Vercel to securely store the encryption keys as environment variables. - **Automation**: We use Upstash for recurring tasks to create reservations on your behalf based on your configured Playlists. - We do not sell or make unauthorized use of your Resy credentials in any way. ## 4. Limitations and Disclaimer ### Service Limitations - **No Affiliation**: Dinefy is not affiliated with or endorsed by Resy. - **Reservation Success**: Successful reservations are not guaranteed due to various factors including: - Restaurants being sold out - No available time slots - Changes in restaurant availability - Limitations in Resy's API - **Resy updates**: in case Dinefy stop working due to changes in Resy's API or any other reason, you agree that we won't reimburse your current subscription. We will do our best to fix the issue, and will cancel your subscription in case it's not possible. ### Financial and Account Risks - **Reimbursement**: At this time, we cannot provide reimbursements. Reimbursement is - **Reservation Responsibility**: Users are solely responsible for managing and canceling their reservations. Dinefy does not cancel reservations on behalf of users, and any fees, penalties, or charges incurred for late cancellations or no-shows are the user's responsibility. - **Account Deactivation Risk**: By using Dinefy, you acknowledge that Resy may deactivate or suspend your Resy account due to the use of automation or other reasons. We are not liable for any actions taken by Resy against your account. ### Liability - Dinefy cannot be held accountable for any financial or other consequences arising from, but not limited to: - Failed reservations - Account deactivations - Penalties imposed by Resy or any restaurant - Password leakage (though we take steps to protect your credentials) - Any other financial losses related to the use of Dinefy ## 5. Prohibited Uses You agree not to: - Use the service for unauthorized or illegal purposes - Interfere with Resy's API or violate their Terms of Service - Attempt to bypass any security measures of Dinefy, Resy, or any third-party system ## 6. Termination We reserve the right to terminate or suspend your access to the service at our discretion, especially if your use violates these Terms of Service or any applicable laws. ## 7. Changes to the Service or Terms We may modify or discontinue the service or update these Terms of Service at any time. Changes will be effective upon posting, and continued use of the service constitutes acceptance of the updated terms. ## 8. Governing Law These terms are governed by the laws of Brazil/SC. ## 9.
